In a stinging rebuke of a large, regional health care system, the New York State Public Health and Health Planning Council (“PHHPC”) has concluded that the termination of our physician-client’s hospital privileges was improper. Thanks to the Firm’s unrelenting advocacy (led by Jim Denlea and John Leifert), the doctor’s privileges were restored, and a report to the National Practitioner Databank was “voided.” Congratulations to Jim and John on their perseverance and victory.

The Firm secured a significant administrative appellate victory for a registered nurse who had been improperly charged in two separate cases of neglect. After initial findings wrongly found the claims against the nurse to be substantiated, which were then upheld on an initial administrative review, the nurse retained Denlea & Carton to pursue an Administrative Appeal before the Justice Center for the Protection of People with Special Needs. Halfway through a heated cross-examination conducted by John Leifert of the Justice Center’s key witness in the first case, the Justice Center conceded that it could not prove either case. As a result, they reversed their findings, sealed both matters, and discontinued all proceedings.
Kudos to John for his successful advocacy which led to the nurse’s exoneration and the restoration of her professional reputation.
The Firm is pleased to have contributed to the Brain Injury Association of New York State’s (BIANYS) March On For Brain Injury event. Established in 1982, BIANYS’s mission is to support individuals and their families living with brain injuries. This annual event is held to raise awareness and funds for brain injury victims throughout the State. Having successfully helped brain injury victims obtain millions of dollars in settlements and recoveries to redress the devastating effects a traumatic brain injury can have on its victim (and his/her family), we are delighted to be able to support such a worthwhile cause.
