Uber passengers rejoice ! The Firm’s two-year battle against the New York Black Car Operators Injury Compensation Fund culminated in a decisive win last month. The Honorable Philip M. Halpern (SDNY) granted summary judgment in plaintiff’s favor, and certified the lawsuit to proceed as a class action. As a practical matter, the Court’s ruling prohibits black car companies (such as Uber and Lyft) from imposing a surcharge on non-cash gratuities, or what the lawsuit challenged as an impermissible “tax on tips.” Media coverage of the Court’s decision can be found at:

Denlea & Carton successfully moved to dismiss all claims against its client, a defendant in a suit for malicious prosecution and prima facie tort in New York Supreme Court, County of Westchester. Our client was sued because he previously filed a lawsuit to stop an improperly noticed town board meeting and had that meeting enjoined. The parties whose applications were to be heard at the town board meeting then brought an action against our client. On September 25, 2020, the Court granted a motion to dismiss all claims against our client. With this pre-discovery motion, our client avoided further litigation and saved significant costs, while also vindicating his actions to stop the improperly noticed meeting.

Denlea & Carton, LLP, a White Plains law firm, is pleased to announce that Steven R. Schoenfeld has joined the firm. Mr. Schoenfeld, a seasoned commercial litigator, joins the Firm’s business litigation practice.

Mr. Schoenfeld graduated summa cum laude from Princeton University and received his law degree from New York University School of Law. He has handled all phases of business and bankruptcy litigation matters, and serves on the American Arbitration Association’s Roster of Neutrals for Commercial Arbitration. “I’m excited to meld my practice with the Firm’s busy caseload,” remarked Schoenfeld. “The synergies are obvious, and I look forward to an exciting path forward.”
